Terms of Service (ToS)

1. Acceptance of Terms
Access to and use of the DataBand platform (hereinafter, the "Service" or "Platform") is subject to the User's acceptance of these Terms of Service. By using the Service, the User declares that they have read, understood, and fully accepted these Terms. If the User does not accept them, they are advised not to use the Platform.
2. Description of the Service
DataBand is a management software platform designed to facilitate the organization and management of musical and operational activities of bands (e.g., archiving sheet music, managing members, etc.). The Platform constantly evolves to provide new organizational tools.
3. Registration and Account Security
To use certain features, the User may be required to register an account. The User is responsible for the confidentiality of their login credentials (username and password) and for all activities occurring through their account. In case of suspected unauthorized use, the User must promptly contact our support at mydataband@gmail.com.
4. User-Generated Content
The User is solely responsible for any data, document, audio file, text, or other material ("Content") uploaded or processed through the Service. By uploading Content, the User guarantees that they own the rights (including copyrights) or have the necessary usage licenses. DataBand claims no ownership over the User's Content but reserves the right to remove, without notice, any files deemed unlawful or in violation of third-party rights.
5. Payments and Subscriptions
Access to certain features or increased storage space may be subject to a paid subscription. Payments are processed through third-party platforms (such as Stripe) with maximum security. Unless otherwise required by mandatory regulations, payments are non-refundable, and no credits are provided for partially used subscription periods.
6. Disclaimer of Warranties ("AS IS")
The Service is provided "as is" and "as available". DataBand provides no explicit or implicit warranties regarding the continuity, uninterrupted availability, or error-free nature of the software. Although we do our best to keep data secure, we do not guarantee absolute protection against data loss or malfunctions. It is the User's responsibility to maintain backup copies of their important Content.
7. Limitation of Liability
To the maximum extent permitted by applicable law, DataBand shall not be liable for direct, indirect, incidental, special, consequential, or punitive damages (including loss of profits, data, or other intangible losses) arising from:
- The use or inability to use the Service;
- Unauthorized access or alteration of the User's transmissions or data;
- Malfunctions of network infrastructure, third-party servers, or temporary service disruptions.
8. Modifications and Suspension of Service
DataBand reserves the right to modify, suspend, or discontinue, temporarily or permanently, in whole or in part, the Service at any time, with or without notice. The User agrees that DataBand will not be liable to them or to any third party for any modification, suspension, or discontinuation of the Service.
9. Changes to Terms
We reserve the right to periodically update or modify these Terms of Service. Changes will take effect as soon as they are published on the Platform. Continued use of the Service after the publication of changes constitutes acceptance of the updated Terms.
